1. Agreement to Terms

By accessing or using Got Me Well ("the Platform"), operated at gotmewell.com, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform. These Terms constitute a legally binding agreement between you ("User", "you") and Got Me Well ("we", "us", "our").

2. Eligibility

You must be at least 16 years of age to use the Platform. By creating an account, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You may register using email/password or Google Sign-In.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You agree to provide accurate, current, and complete information.
  • You are responsible for all activities under your account.
  • Notify us immediately of any unauthorized use.

4. Services

The Platform provides AI-powered content generation services including:

  • AI-generated life lessons and wisdom content.
  • Social media content creation (TikTok scripts, Instagram carousels, captions).
  • Viral content generation with AI-generated images.
  • Quote card generation.
  • Personal branding image generation.

Services are provided "as-is" and "as-available". We reserve the right to modify, suspend, or discontinue any part of the service at any time.

5. Subscription Plans & Payments

  • Free Tier: Limited access to core features at no cost.
  • Pro Tier: Enhanced access with increased usage limits.
  • Business Tier: Full access with maximum usage limits and priority features.

Payments are processed via Stripe. All prices are in Euros. Subscriptions are billed monthly. You may cancel anytime; access continues until the end of the current billing period. Refunds are handled per applicable consumer protection laws.

6. Intellectual Property

  • Platform IP: All rights in the Platform (design, code, algorithms, branding) are owned by Got Me Well.
  • User Content: You retain ownership of content you upload (e.g., photos).
  • Generated Content: AI-generated content is licensed to you for personal and commercial use. We do not claim ownership.
  • You grant us a limited, non-exclusive license to process uploaded content solely for providing the services.

7. Acceptable Use

You agree not to:

  • Use the Platform for unlawful, harmful, or fraudulent purposes.
  • Generate defamatory, abusive, hateful content or content violating others' rights.
  • Reverse-engineer, decompile, or hack the Platform.
  • Use automated tools or bots beyond intended use.
  • Circumvent usage limits, authentication, or security measures.
  • Resell or sublicense access without authorization.
  • Impersonate any person or entity.

8. AI-Generated Content Disclaimer

  • Content is for informational and creative purposes only.
  • It does not constitute professional advice (financial, medical, legal, or otherwise).
  • We do not guarantee accuracy, completeness, or suitability of AI-generated content.
  • You are responsible for reviewing content before publishing or using it.
  • AI-generated images may not perfectly represent real individuals or scenarios.

9. Limitation of Liability

To the maximum extent permitted by law, Got Me Well shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total aggregate liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Got Me Well and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that should survive termination remain in effect.

12. Governing Law & Dispute Resolution

These Terms are governed by EU law and the applicable national laws where the data controller is established. Disputes shall first be resolved through good-faith negotiation. If unresolved, they shall be submitted to the competent courts of the relevant jurisdiction.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated via the Platform or email. Continued use after changes constitutes acceptance.

14. Severability

If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
